Acceptance of Terms

By accessing or using CastMyAgent ("the Service"), operated at castmyagent.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Account Terms

• You must be at least 18 years old to use this Service.
• You are responsible for maintaining the security of your account and password.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating an account.

Persona Licensing

When you purchase or access a persona on CastMyAgent, you receive a non-exclusive, non-transferable license to use that persona in your AI agents and workflows. This license grants you the right to:

• Use the persona's character brief, voice configuration, and associated files in your own AI applications
• Deploy the persona in commercial or personal projects
• Modify the persona files to suit your specific use case

You may not resell, redistribute, or sublicense the persona files themselves. The license is for usage in your applications, not for redistribution of the raw assets.

Payments and Refunds

All payments are processed securely through Stripe. By making a purchase, you agree to the following:

• Per-talent bookings are one-time purchases. Once the persona files are delivered, the sale is final.
• Studio Pass subscriptions are billed monthly. You may cancel at any time, and your access will continue until the end of the current billing period.
• Refund requests for individual bookings will be considered on a case-by-case basis within 7 days of purchase.
• Prices are subject to change with reasonable notice.

Intellectual Property

All personas, character briefs, headshots, voice configurations, and other content on CastMyAgent are the intellectual property of CastMyAgent unless otherwise stated. Your purchase grants you a usage license as described in the Persona Licensing section above, but does not transfer ownership of the underlying intellectual property.

Acceptable Use

You agree not to use CastMyAgent personas or the Service to:

• Impersonate real individuals or create misleading representations
• Generate harmful, abusive, or illegal content
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service or its infrastructure

No Liability for Agent Actions

CastMyAgent provides downloadable persona packages — including system prompts, character briefs, and voice configurations — that are designed to be used as inputs for third-party AI models and agent frameworks. CastMyAgent does not operate, host, or control any AI model, agent, copilot, or workflow in which you deploy these personas.

You acknowledge and agree that:

• CastMyAgent is not responsible for any action taken by, output generated by, or behavior exhibited by any AI agent or application in which a CastMyAgent persona is deployed — including but not limited to code execution, API calls, data processing, sending communications, financial transactions, file operations, or any other automated action
• Persona packages are starting-point character templates, not guarantees of specific AI behavior — AI agents are inherently unpredictable and may take actions that deviate from or go beyond the persona guidelines
• You are solely responsible for configuring, testing, monitoring, and constraining any AI agent or application in which you use CastMyAgent persona files, including setting appropriate permissions, access controls, and action boundaries
• You are solely responsible for any harm, loss, damage, or liability caused by any action taken by an AI agent or application that uses CastMyAgent persona files, including but not limited to unauthorized actions, data loss or exposure, financial losses, service disruptions, or decisions made or executed by the agent
• You must implement appropriate safeguards, permission controls, human oversight, and action limits for any deployment of AI agents using CastMyAgent personas, particularly in production environments where agents have access to tools, APIs, databases, or external services

Indemnification

You agree to indemnify, defend, and hold harmless CastMyAgent, its owners, operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of CastMyAgent persona files, including but not limited to claims arising from any action taken by, output generated by, or consequence of any AI agent or application in which you deploy CastMyAgent personas.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free. CastMyAgent makes no warranty that any persona will produce specific, accurate, or desirable behavior when used with any AI model or agent framework, nor that any agent using a CastMyAgent persona will act within intended boundaries.

Limitation of Liability

To the maximum extent permitted by law, CastMyAgent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. This includes, without limitation, any damages arising from any action taken by, output generated by, or consequence of AI agents or applications that use CastMyAgent persona files, including unauthorized actions, data loss, financial losses, or service disruptions. In no event shall CastMyAgent's total liability exceed the amount you paid for the specific persona package giving rise to the claim.

Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service. Upon termination, your right to use the Service will immediately cease. Any licenses granted for previously purchased personas will survive termination.

Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.
